ARTICLES V THROUGH XII
ARTICLE V - RECALL OF NATIONAL OFFICER
- Section 1.
- Any elected Officer of the National Federation of Independent Unions may be removed from office at any time for just cause.
- Section 2.
- Willful violation of this constitution or any by-laws subject to it, misappropriation of NFIU funds, conduct unbecoming to an Officer, or working in the cause of any labor organization or cause which is detrimental to, or opposed to the National Federation of Independent Unions, shall be among the causes for removal from office.
- Section 3.
- Written charges against any Officer or Officers must be signed by no less than five (5) affiliated Unions in good standing. A copy of said petition shall be forwarded to the National Office. The Executive Officers shall meet no more than thirty (30) days thereafter for a hearing. The accused Officer or Officers, shall be notified by Registered Mail, at his last known address, of the charge, not more than twenty (20) days prior to the hearing, and afford him an opportunity to be present to defend himself. If the charges are sustained by a two-thirds (2/3) vote of the National Executive Officers present and voting, that Officer shall be suspended. Such suspension shall be in effect until the next National Convention at which time the suspended Officer shall be offered the opportunity to appear and defend himself.
- Section 4.
- Any member shall be entitled to testify as a witness for or against the accused. The delegates at the Convention shall vote on the suspension and their decision shall remain final. If the accused Officer does not appeal to the Convention, the action of the Executive Officers shall stand and his office shall be declared vacant.
ARTICLE VI - CHARTERS, DUES AND FEES
- Section 1.
- The National Executive Officers shall be authorized to grant charters to eligible unions making proper application.
- Section 2.
- Charters shall be issued to all Unions granted membership in the National Federation of Independent Unions. Charters shall be numbered and recorded by the National Executive Secretary.
- Section 3.
- Charter application fee shall be One Hundred Dollars ($100.00).
- Section 4.
- All affiliated unions shall pay monthly dues to the National Federation of Independent Unions based on their membership as per capita paid: First year of affiliation $3.00 per member per month Second year of affiliation $4.00 per member per month Third year of affiliation $5.00 per member per month Fourth year of affiliation full per capita according to the schedule agreed to between the NFIU and LIUNA.
- Section 4a.
- Observer affiliate dues shall be $100.00 per month with no votes.
- Section 5.
- The National Executive Officers shall be authorized to make special dispensation, with respect to dues and fees only, for affiliates or charter applicants whenever there appears to be just cause.
- Section 6.
- Each affiliated Union shall remit its dues to the National Office on or before the last day of each month in which it is due.
- Section 7.
- Unions more than sixty (60) days in arrears with their monthly dues payments shall be considered not in good standing and ineligible to vote except by special dispensation from the National Executive Officers for good and sufficient reason subject to the National Convention.
- Section 8.
- The fiscal year of this Organization shall commence on the first (1st) day of January, and end the thirty-first (31st) day of December.
- Section 9.
- The Federation shall charter State Councils within each region. The purpose of the Council is to better represent its affiliates in State matters and legislation.
ARTICLE VII - CAUSES FOR ACTION
- Section 1.
- The National Federation of Independent Unions shall not be responsible or liable for the payment of any cause of action, demands, charges, judgments, liens, debts, or defaults; incurred by any affiliated Organization; nor shall the funds of the National Federation of Independent Unions be subject to execution or attachment for the payment of any cause of action, actions, demands, charges, judgments, liens, debts, or defaults incurred by or against any local Organization, provided, however, that the National Federation of Independent Unions, by the majority vote of the National Executive Officers present and voting, may assume or authorize payment from its own Treasury of any cause of action, actions, demands, charges, judgments, liens, debts, or defaults incurred by or against any local Organization.
- Section 2.
- No local Organization shall be responsible for or liable for the payment of any cause of action, actions, demands, charges, judgments, liens, debts, or defaults incurred by the National Organization; nor shall the funds of any local Organization be subject to the executive or attachment for the payments of any cause of action, actions, demands, charges, liens, judgments, debts, or defaults incurred by or against the National Organization or any other local Organization.
- Section 3.
- Failure by an Affiliate to produce required information concerning his Constitution and By-Laws, a copy of its contract with employer, and/or financial statement sufficiently detailed to meet the government compliance filing requirements, within a reasonable time after request for such information has been made by the NFIU National Office, shall constitute grounds for immediate suspension and/or revocation of the charter subject to the next meeting of the National Executive Officers.
- Section 4.
- An Officer or member of an affiliated union may appeal to the National Federation of Independent Unions for a hearing and ruling on any matter relating to his rights and privileges as a union member. Ruling on such questions shall be made by the National Executive Officers subject to the National Convention.
ARTICLE VIII - AUTONOMY
- Section 1.
- The local autonomy of unions affiliated with the National Federation of Independent Unions shall remain forever inviolate.
ARTICLE IX - AMENDMENTS
- Section 1.
- The amendments of By-Laws shall be in the same manner as required for amendments to the Constitution.
ARTICLE X - RULES OF ORDER
- Section 1.
- Robert Rules of Order shall apply on any question of parliamentary procedure, or law, not covered by this Constitution.
ARTICLE XI - GENERAL PROVISIONS
- Section 1.
- Nothing in this Constitution of this Organization shall be interpreted to mean that any Officer, Member, affiliate Representative, or Employee of the National Federation of Independent Unions, in order to perform his or their duties or demonstrate loyalty to the National Federation of Independent Unions shall be required to violate the laws of the United States, subdivision thereof, or the moral law.
- Section 2.
- Members of any organization which have for their purpose the overthrow of the United States Government violence or other subversive means are not eligible to hold office or membership in this Organization. Likewise, unions which are or may become dominated by such subversive Organizations are not eligible to acquire or maintain affiliation in the National Federation of Independent Unions.
- Section 3.
- Unions which withhold their per capita tax willfully and without authority from the National Federation of Independent Unions shall be subject to loss of all rights as affiliates or may have their affiliation severed and their charter revoked at the discretion of the National Executive Officers. Any exception to this provision shall be after due consideration and shall require a two-thirds (2/3) majority vote at meetings of the National Executive Officers subject to appeal at the National Convention.
- Section 4.
- Where the masculine gender is used in this Constitution and By-Laws, it shall mean the feminine gender as well.
- Section 5.
- The National Federation of Independent Unions shall not discriminate against any person because of race, sex, color, creed, religion, or national origin.
ARTICLE XII - UNION LABEL
- Section 1.
- Authorization for use of the NFIU Union Label may be granted to an affiliate union subject to the Union Label Agreement.
