ARTICLES III THROUGH VI
ARTICLE III - NATIONAL OFFICERS
- Section 1.
- The National Executive Officers shall consist of a President, a National Executive Secretary-Treasurer, and five (5) National Executive Vice Presidents. They shall assume office on October 1st following their election, and shall serve for a term of three (3) years, effective 1984.
- Section 1a.
- The five (5) National Executive Vice Presidents shall be elected by Regions: Region 1. Main, Vermont, New Hampshire, Massachusetts, New York, Rhode Island, Connecticut, New Jersey, Pennsylvania, Delaware, Maryland and the District of Columbia. Region 2. West Virginia, Virginia, North Carolina, South Carolina, Georgia, and Florida. Region 3. Minnesota, Wisconsin, Iowa, Illinois, Michigan, Indiana and Ohio. Region 4. Missouri, Arkansas, Kentucky, Tennessee, Mississippi, Alabama, Louisiana, Nebraska, Colorado, Kansas, Oklahoma, New Mexico and Texas. Region 5. North Dakota, South Dakota, Arizona, Utah, Wyoming, Montana, Washington, Oregon, Idaho, Nevada, California, Hawaii and Alaska. Affiliated unions from each region will make recommendations to the Convention Nominating Committee as to whom they wish to be elected from their Region. Any region where there are no affiliates - that region shall remain vacant until such time that there are affiliates in that particular region at which time the President may fill the vacancies between conventions.
- Section 1b.
- There shall be three (3) Regional Vice Presidents from each Region. They shall assume office on October 1st following their election and shall serve for a term of three (3) years.
- Section 1c.
- The National Executive Vice Presidents to be first in line to fill the office of the National President in case of vacancy or absence will be elected by the five (5) National Executive Vice Presidents immediately following the election with each Executive Vice President present and voting allowed one (1) vote.
- Section 2.
- At all meetings of the National Executive Officers, each Officer shall have one (1) vote, except that the National President shall vote only in case of a tie.
- Section 3.
- The National Executive Officers shall fill all vacancies by appointment between Conventions.
- Section 4.
- All vacancies in the Office of Regional Vice President shall be filled by nominations by the National Executive Officers subject to majority approval of the National Executive Officers at the next meeting, or by mail when more expedient.
- Section 5.
- A National Officer shall be automatically removed from office anytime their parent Union becomes delinquent in per capita dues in excess of three (3) months.
- Section 6.
- In the event that an affiliate Union disaffiliates, or loses its good standing for any cause, the authority of any member of that Union to serve as a National Executive Officer or Regional Vice President will become immediately invalid and such office shall be declared vacant until filled in accordance with terms of the National Constitution and By-Laws.
- Section 7.
- The National Executive Officers shall meet as required at the call of the National President, or by a majority of the National Officers.
- Section 8.
- All National Executive Officers at the expiration of their term shall deliver to their successors all books, papers, money, or other property belonging to the National Federation of Independent Unions, or its affiliate Unions, and shall not be relived from their bonds or obligations until in compliance with this section.
- Section 9.
- The National Executive Officers shall authorize the payment of proper wages and expenses where necessary in the best interests of this Organization. No funds of the Organization shall be paid out except by the authority of the National Executive Officers as necessary to administer the program and policies as approved by the National Executive Officers.
- Section 10.
- Salaries of the National Executive Officers shall be determined by the National Convention with the exception of the National President, whose salary shall be determined by the National Executive Officers.
- Section 11.
- The National President, National Executive Secretary-Treasurer, and the five (5) National Executive Vice Presidents shall be the permanent Legislative Committee.
- Section 12.
- National Executive Committee - Each union shall be entitled to one delegate to serve on the National Executive Committee. The Executive Committee member shall be elected by the local. The National Executive Committee shall meet with the National Executive Officers prior to the convention to review the proposed agenda.
ARTICLE IV - POWERS OF ADMINISTRATION
- Section 1.
- The National Federation of Independent Unions shall be governed by its membership in the following manner:
- Section 1a.
- The highest tribunal shall be the National Convention.
- Section 1b.
- Between National Conventions, the governing body shall be the National Executive Officers.
- Section 1c.
- Between National Conventions, the executive authority shall be vested in the National President, subject to direction by the National Executive Vice Presidents. The National President shall report his actions to the National Executive Officers and the National Convention for their approval or rejection.
ARTICLE V - NATIONAL CONVENTION
- Section 1.
- The National Federation of Independent Unions shall meet in regular convention each year at such place as shall be decided upon by the previous convention action. The year that there is no election of officers, the convention will be held in Washington, D.C. in conjunction with the legislative conference. (Effective 10-1-93)
- Section 2.
- Should any condition arise that would prevent a Convention being held in the city decided upon by convention action, the place for holding it can be changed by the National Executive Officers.
- Section 3.
- The National Executive Officers shall have the power to change the date on which a National Convention is to convene, but any change shall not be for more that ninety (90) days before or after the original date fixed.
- Section 4.
- A Special Convention will be called upon petition filed in writing with the National Executive Secretary by ten (10) of the affiliated Unions in good standing. The petition must specify the reason for the call of the meeting.
- Section 4a.
- Unless the petition specifies a later date, the Special Convention shall be held no later that sixty (60) days from receipt of the petition and no sooner that thirty (30) days from issuance of notice to all affiliates.
ARTICLE VI - AMENDMENTS
- Section 1.
- This Constitution shall be subject to proper amendments at any regular or special Convention by the affirmative vote of two-thirds (2/3) of the delegates present and voting.
- Section 2.
- All proposed constitutional changes must be presented to the National Office at least sixty (60) days prior to the Convention and the National Office shall mail the proposed changes to all affiliates at least thirty (30) days prior to the Convention.
- Section 3.
- All proposed amendments to the constitution must be submitted to the Constitution and By-Laws Committee in written form.
- Section 4.
- The Constitution and By-Laws Committee will study proposed amendments and present same to the convention for its modification, approval, or rejection. The Constitution and By-Laws Committee may present the proposed changes with or without recommendations.
