ARTICLES I THROUGH III

ARTICLE I - NAME AND CONSTITUTION

Section 1.
This Organization shall be known as the National Federation of Independent Unions. It may be abbreviated or referred to as the N.F.I.U. or National Federation.

Section 2.
The National Office shall be in the Metropolitan Area of Philadelphia, Pennsylvania, from where the business of the National Federation of Independent Unions shall be conducted; any Regional Office other than the Philadelphia, Pennsylvania office must be authorized by the National Executive Officers and then only after the Philadelphia Office is fully staffed.

Section 3.
This Organization shall consist of an unlimited number of Unions chartered in accordance with the provisions contained herein.

Section 4.
When eight (8) or more Unions subscribe to this Constitution, the National Federation of Independent Unions shall be officially established.

Section 5.
This Organization shall not be dissolved while there are two (2) dissenting Unions.

ARTICLE II - MEMBERSHIP

Section 1.
Any bona-fide Independent Labor Union may become a candidate for affiliation by filing an application with the National Executive Officers, accompanied by the charter fee, a copy of the applying Union's Constitution and By-Laws, copies of working agreements, and any other data that may be requested. The Constitution, working agreement amount of approximate membership, and any other data shall be thoroughly investigated by the National Officer recommending the acceptance of said applicant; and if found in order, the Candidate's application shall be presented to the National Executive Officers for final disposition. This presentation of application to the National Executive Officers may be by mail. One (1) dissenting vote shall require denial of the application pending investigation by the National Executive Officers. Following investigation by the National Executive Officers, the rejected application may again be submitted to the National Convention for further consideration. If the National Executive Officers vote unanimously for approval of said candidate's application, then said applicant shall be eligible for affiliation.

Section 1a.
No Union will be eligible for charter unless the charter includes the total membership and not a portion thereof, such as a local or locals or any other part of the parent organization. The Executive Vice Presidents shall be in charge of the State Councils in their region. It shall be their duty to set active State Councils and to work with the State Legislature and notify their affiliates in their region of all State Legislation's that pertain to the Federation or their affiliates.

Section 1b.
There will be available observer membership. This will entitle bona-fide unions to become observers with limited participation. Observer membership will be limited to two (2) years.

Section 2.
Appropriate and acceptable Independent Union groups, constituting Regional, State, Area, Industry, or Craft Organizations, 'and organizing councils', filing proper application with the National Executive Officers, shall be issued charters on such Regional, State, Industry, Area or Craft Organization basis, following due acceptance by the National Executive Officers in accordance with terms of this Constitution.

Section 2a.
Regional, State Councils, and Organizing Councils, shall be eligible to make applications for charter. Eligibility of membership shall be determined in the same order as local union. No Regional, State, or Organizing Council shall be required to pay dues if all member locals are members and hold charters with the National Federation of Independent Unions. The United Independent Union and National Industrial Workers are organizing councils under NFIU. Any union joining or affiliated with the Regional or State Council, and are not members of the National Federation of Independent Unions, that Council will be required after one (1) year to pay per capita dues according to By-Laws Article VI, Section 4, for this Union.

Section 3.
In the event an affiliated Union shall fail to pay the per capita dues as outlined in By-Laws Article VI, Section 4, for the period of three (3) months, such Union shall be notified by their arrearage by the National Office through the medium of Registered or Certified Mail and at the expiration of ten (10) days from the date of such notice; if the payment of dues in arrears has not been received by the National Office, the charter of said Union shall be revoked. Such Union will be compelled to return the charter along with any and all other official property and shall discontinue using the name and/or insignia of the National Federation of Independent Unions. All dues in arrears are due and owing until the charter is returned.

Section 4.
Any affiliated Union found guilty of violating any part of this Constitution and By-Laws, or of conduct detrimental to the good of this Organization, may by two-third (2/3) vote of the National Executive Officers present and voting at any regular or special meeting, have its membership suspended in the National Federation of Independent Unions. Such suspension shall be in effect until the next meeting of the National Convention, at which time the National Convention will vote on the membership of the affiliate Union being revoked; prior notification having been given the Union to afford them the opportunity to appear before the National Convention to defend itself.

Section 5.
The charter fee will be returned in case the application is rejected. After applications have been processed and charter issued, due to the expense involved in such process, no charter fees or dues will be refunded in cases where charters are revoked, suspended, or the affiliate is disqualified from membership in any manner. All constitutions, contracts, and other materials required or submitted in connection with affiliation shall become and thereafter remain the property of the National Federation of Independent Unions.

Section 6.
Affiliates shall comply with Federal and State requirements in order to remain in good standing.
